DECISION & ORDER ON MOTION

Motions by appellant to continue a stay granted by order of this court dated February 4, 2010 pending the determination of an appeal from a final judgment of the Civil Court of the City of New York, Kings County, entered December 1, 2009. Motion by respondent to file late opposition to appellant's motions.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is,
ORDERED, on the court's own motion, that the motions by appellant and the motion by respondent are consolidated for purposes of disposition; and it is further,
ORDERED that the motion by respondent to file late opposition is granted and the opposing papers are deemed timely served and filed; and it is further,
ORDERED that the motions by appellant to continue the stay contained in the order of this court dated February 4, 2010 are denied.
