DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Selim Zherka, Appellant.

Motion by appellant pursuant to CPL 460.50 to stay, pending the determination of the appeal, the execution of so much of a judgment of conviction of the City Court of Mount Vernon, Westchester County, rendered February 23, 2010, as sentenced appellant to 20 hours of community service.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is,

ORDERED that the motion by appellant to stay the execution of so much of the judgment as sentenced him to 20 hours of community service is granted on condition that the appeal be perfected by September 3, 2010; and it is further,

ORDERED that in the event that the above condition is not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
