Motion by Michael D. Elbert, Esq., to relieve counsel assigned to prosecute an appeal from a judgment of the County Court, Suffolk County, rendered January 5, 2010, and substitute him as assigned counsel.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is denied with leave to renew on or before August 16, 2010, upon proper papers, including documentation that he has been appointed to the Suffolk County 18-B Appellate Panel for the purposes of this appeal.
