It is Ordered that the motion to dismiss the appeal is denied. The appeal has been perfected for the October 2010 term. Answering briefs are to be served and filed by August 23, 2010. The motion to vacate the stay is denied, without prejudice to renew in the event the appellant fails to timely tender accruing use and occupancy to the petitioner, pending the determination of the appeal. The appellant claims that to have paid all arrears to the petitioner. The cross-motion for various relief is denied as moot.
