It is hereby ORDERED that the motion is dismissed as unnecessary.

Memorandum: Absent proof that the Attorney General's Office served a copy of the

order of Supreme Court, Wyoming County dated January 28, 2010 with written notice of its entry upon petitioner, there is no basis upon which to conclude that the time to take an appeal has begun to run or that the relief sought is necessary (see CPLR 5513 [a]).
