ORDER ON APPLICATION

Application by the the petitioner to withdraw a proceeding pursuant to CPLR article 78 in the nature of mandamus, inter alia, to compel the respondent Michael Aloise, a Justice of the Supreme Court, Queens County, to release a copy of the petitioner's presentencing report in a matter entitled People v Singleton, pending in that court under Indictment Nos. 7757/91, 7758/91, 7759/91, 352/92, 694/92, and 11751/92.

Upon the papers filed in support of the application and no papers having been filed in opposition thereto, it is

ORDERED that the application is granted and the proceeding is deemed withdrawn, without costs or disbursements.
