DECISION AND ORDER ON MOTION |
Motion for extension of time to perfect appeal taken by
plaintiff.
Motion for extension of time to perfect cross appeal and tor consolidate appeals
and cross appeal.
Upon the papers filed in support of the motions and the papers filed in
response thereto, it is
ORDERED that the motion to consolidate the appeals and the
cross appeal is granted, without costs, and to the extent that the appeals and the cross appeal shall
be heard together, and it is further
ORDERED that the motion for an extension of time
to perfect the appeal taken by plaintiff is granted, without costs, and the time to perfect the appeal
is extended to September 20, 2010, and it is further
ORDERED that the motion for an
extension of time to perfect the cross appeal is granted, without costs, and the time is extended to
November 4, 2010. Defendant's brief shall also contain the points of argument on the cross
appeal and the appeal taken by defendant by notice of appeal dated June 29, 2010.
