Petitioner-appellant having applied for permission to proceed as a poor person and for assignment of counsel on the appeal taken herein from an order of the Family Court, Monroe County, entered in the Office of the Clerk of said Court on June 25, 2009 (CAF 10-01342),

Now, upon reading and filing the certification of Kathleen P. Reardon, Esq., dated June 11, 2010, and due deliberation having been had thereon,

It is hereby ORDERED that the application is granted, and

It is further ORDERED that Kathleen P. Reardon, Esq., 40 Humboldt Street, Rochester, New York 14607, is hereby assigned as counsel to conduct the appeal, and

It is further ORDERED that petitioner-appellant shall file the original stipulated or settled record and ten briefs on the appeal, together with proof of service, on or before August 6, 2010, and in the event of failure to so perfect the appeal is hereby dismissed without further order, and

It is further ORDERED that the appeal taken herein from the order of the Family Court, Monroe County, entered April 15, 2009 (CAF 09-01431), is dismissed on the ground that no appeal lies from an order that has been superseded by an amended order.
