On the court's own motion, it is
ORDERED that its decision and order on motion dated July 13, 2009, in the above-entitled matter, which granted a motion, inter alia, to assign new counsel to represent Barbara P. on an appeal from an order and judgment (one paper) of the Supreme Court, Queens County, dated December 9, 2008, is amended by deleting from the second decretal paragraph of the order dated July 13, 2009, the words "pursuant to statute (Judiciary Law § 35)", and substituting therefor the words "pursuant to Mental Hygiene Law § 81.10 and County Law article 18-B (see St. Luke's-Roosevelt Hosp. Ctr., 89 NY2d 889)".
