DECISION & ORDER ON MOTION

Motion by plaintiff Luis Alchundia and appellant Ana Laborde to enlarge the time to perfect an appeal from an order of the Civil Court of the City of New York, Queens County, entered March 20, 2009.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is,
ORDERED that so much of the motion as is by appellant Ana Laborde for an enlargement of time to perfect the appeal is granted and the appeal shall be perfected by September 3, 2010; and it is further,
ORDERED that so much of the motion as is by plaintiff Luis Alchundia is denied; and it is further,
ORDERED that in the event the appeal is not perfected on or before September 3, 2010, the court, on its own motion, may dismiss the appeal, or respondents may move to dismiss the appeal on three days' notice, and may serve such application in person.
We note that plaintiff Luis Alchundia has not filed a notice of appeal.
