Motion by the appellant to stay all proceedings, including the trial, in a proceeding entitled Matter of Hawthorne Gardens Owners Corp. v Jacobs, pending in the District Court, Nassau County, under Index No. SP 004412/09, pending hearing and determination of an appeal from an order of the Supreme Court, Nassau County, entered May 7, 2010, and for a preference in the calendaring of the appeal.
