| DECISION & ORDER ON MOTION |
Motion by the appellant, in effect, for leave to perfect an appeal from a judgment of the Supreme Court, Suffolk County, entered June 24, 2009, without trial exhibits and to enlarge the time to perfect the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is, in effect, for leave to perfect the appeal without trial exhibits is granted to the extent that on or before August 24, 2010, the respondent's attorney is directed to provide the appellant with copies of all trial exhibits in the possession of the respondent's attorney, with the appellant to pay the costs of reproduction, and that branch of the motion is otherwise denied; and it is further,
ORDERED that the branch of the motion which is to enlarge the time to perfect the appeal is granted, the appellant's time to perfect the appeal is enlarged until September 23, 2010, and the record or appendix on the appeal and the appellant's brief must be served and filed on or before that date.
