ORDERED that the order on application of this court dated August 3, 2010, in the above-entitled appeal which granted an application by the respondents-appellants pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a reply brief on an appeal and cross appeal from an order of the Supreme Court, Suffolk County, dated September 10, 2009, is amended by deleting from the decretal paragraph thereof the date "August 9, 2010," and substituting therefor the date "August 17, 2010".
