Motion by the appellant to resettle a decision and order of this court dated January 26, 2010, which determined an appeal from an order of the Supreme Court, Rockland County, entered March 30, 2009, and for leave to appeal to the Court of Appeals from the decision and order of this court. Cross motion by the respondents to resettle the decision and order of this court dated January 26, 2010, and for leave to reargue the appeal from the order of the Supreme, Rockland County, entered March 30, 2009.
Upon the papers filed in support of the motion and cross motion and the papers filed in opposition thereto, it is
ORDERED that the motion and cross motion are denied.
