Motion by the appellant to direct the respondent to pay the sum of $52,708.21 for "counsel fees and necessary costs" incurred in connection with an appeal from a judgment of the Supreme Court, Suffolk County, entered December 4, 2008, which was determined by decision and order of this court dated April 6, 2010.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied.
