ORDERED that its decision and order on motion dated August 4, 2010, in the above-entitled matter, which granted a motion by the respondent, on an appeal from a judgment of the County Court, Westchester County, rendered June 29, 2004, is amended by deleting from the caption thereof Indictment Number "03-01605" and substituting therefor Indictment Number "02-00384."
