ORDERED that its decision and order on motion dated July 28, 2010, as amended by decision and order on motion dated July 29, 2010, in the above-entitled matter, which granted a motion by the appellant, on an appeal from an order of the Supreme Court, Kings County, dated December 23, 2008, issued pursuant to CPL 440.30, is amended by deleting from the caption thereof Indictment Number "1143/80" and substituting therefor Indictment Number "439/88."
