Motion by appellant for a stay pending the determination of an appeal from an order of the Civil Court of the City of New York, Kings County, entered April 20, 2010.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is,
ORDERED that the motion by appellant for a stay pending the determination of the appeal is denied without prejudice to renewal upon proper service.
While appellant served the order to show cause upon respondent, he failed to serve respondent with the papers in support of the order to show cause.
