| DECISION & ORDER ON MOTION |
Motion by the respondent on an appeal from a judgment of the Supreme Court, Queens County, rendered April 20, 2009, for leave to file an oversized brief containing 59,138 words or alternatively 55,000 words, and to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is for leave to file an oversized brief is granted to the extent that the respondent may file an oversized brief containing 45,000 words, and that branch of the motion is otherwise denied; and it is further,
ORDERED that the branch of the motion which is to enlarge the time to serve and file a brief is granted, the respondent's time to serve and file a brief is enlarged until September 20, 2010, and the respondent's brief must be served and filed on or before that date.
