The People of the State of New York, Respondent, v Vishwanath Ramlakhan, Defendant.

Application by defendant, pursuant to CPL 450.15 and 460.15, for a certificate granting leave to appeal to this court from an order of the Criminal Court of the City of New York, Richmond County, dated January 21, 2010, which has been referred to me for determination.

Upon the papers filed in support of the application and the papers filed in opposition thereto, it is

ORDERED that the application is denied.

Upon reargument of defendant's CPL 440.10 motion, the Criminal Court of the City of New York, Richmond County, vacated the judgment of conviction, rendering moot the instant application for a certificate granting leave to appeal from the order dated January 21, 2010, which had denied defendant's initial CPL 440.10 motion to vacate the judgment.
