The People of the State of New York, Respondent, v Hommy Colon, Appellant.

Motion by appellant to vacate an order of this court dated November 17, 2009 which dismissed an appeal from a judgment of conviction of the City Court of Middletown, Orange County, rendered July 20, 2009.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is,

ORDERED that the motion by appellant to vacate the dismissal of the appeal is denied.

Appellant fails to show good cause for his failure to timely perfect the appeal.
