Stefan Lavrushin, Appellant, v Mikhail Kogan (Korr Realty), Respondent.

Motion by appellant pro se for leave to prosecute an appeal from a judgment of the Civil Court of the City of New York, Kings County, entered November 5, 2009, as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is,

ORDERED that the motion by appellant pro se for leave to prosecute the appeal as a poor person and for the assignment of counsel is denied without prejudice to renewal upon proper notice.

Absent is an affidavit of service showing service of the motion papers on the Corporation Counsel as mandated by CPLR 1101 (c).
