Beaux Arts II LLC v Azumendi, Mar. de Larracoechea
It is Ordered that the respondent-appellant's motion to supplement the record is denied. The Court notes that the appellant was given permission to have the complete file of the Civil Court transferred to this Court. In addition, the petitioner-respondent has voluntarily agreed to provide a copy of the six documents offered at the inquest to the appellant by August 27, 2010. Said exhibits may also be submitted to this Court at the time of filing of the appellant's briefs. The stay is continued to September 7, 2010. This is to afford the appellant a final opportunity to perfect this appeal and thereafter move for a further continuation of the stay. Otherwise, the warrant of eviction may be enforced after September 7, 2010. No further extension of time will be granted ( see 22 NYCRR 640.6 ).
