ORDERED that the order on certification of this court dated August 24, 2010, in the above-entitled matter is recalled and vacated and the following order on certification is substituted therefor:

Appeal by the Presentment Agency from an order of the Family Court, Kings County, dated May 7, 2010. Pursuant to Family Court Act §§ 1118 and 1120, and upon the certification of Jane Fosbinder, Esq., dated July 30, 2010, it is

ORDERED that the respondent is granted leave to proceed as a poor person on the appeal, and the following named attorney is assigned as counsel to represent the respondent on the appeal :

(2) the respondent is not interested in defending the appeal, or that she has been unable to contact the respondent, and wishes to be relieved of the assignment; and it is further,

ORDERED that upon a determination that the respondent is interested in defending with the appeal, the assigned counsel is directed to serve a copy of this order upon the clerk of the court from which the appeal is taken.
