It is Ordered that the motion for a continuation of the stay is granted provided that the appellant continues to pay for accruing use and occupancy on each subsequent rental due date, without prejudice. Otherwise, the petitioner-respondent may move on five days' notice for an order vacating the stay. The appeal will be scheduled for the OCTOBER 2010 term. Answering briefs are to be served and filed by September 7, 2010. Reply briefs, if any, are to be served and filed by September 15, 2010.
