Now, upon reading and filing the statement of Hector Fuentes dated July 18, 2010, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion be and the same hereby is granted to the extent that the order of this Court entered June 22, 2010 is hereby amended by striking therefrom the date July 22, 2010 and inserting in place thereof the date September 17, 2010 (see People v Sher, 35 NY2d 310).
