Appellant having moved for an extension of time to perfect the appeals taken from a judgment and an order of the Supreme Court entered in the Office of the Clerk of the County of Oswego on September 24, 2009 and December 7, 2009, and
Respondent Steven E. Gleason, Sr. having cross-moved to dismiss the appeals from the same judgment and order on the ground that appellant failed to perfect timely the appeals,
Now, upon reading and filing the affirmations of Martha L. Berry, Esq. dated July 21, 2010, and July 29, 2010, the affirmation of Sheila Finn Schwedes, Esq. dated July 27, 2010, the notices of motion and cross motion with proof of service thereof, the affirmation of David H. Walsh, IV, Esq. dated July 28, 2010, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks an extension of time to perfect the appeals is dismissed with leave to make a new motion for an extension within 60 days after the United States Bankruptcy Court stay has been resolved, and
It is further ORDERED that the cross motion is dismissed without prejudice.
