Respondent having moved for permission to file a respondent's brief in excess of the page limitation prescribed pursuant to 22 NYCRR 1000.4(f)(3) on the appeal taken from a judgment of the Supreme Court, Monroe County rendered January 16, 2009, and for other relief and appellant having cross-moved for an extension of time to file and serve a reply brief and for other relief,

Now, upon reading and filing the affirmation of Leslie E. Swift, Esq., dated July 22, 2010, the notice of motion with proof of service thereof, the affirmation of Mary Davison, Esq., dated August 5, 2010, the notice of cross motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion be is granted and respondent is permitted to file a 125 page brief, and

It is further ORDERED that the time to file and serve a respondent's brief is extended to September 10, 2010, and

It is further ORDERED that the cross motion is granted, and appellant is permitted to file a 50 page reply brief, and

It is further ORDERED that the time to file and serve a reply brief is extended to October 1, 2010.
