Motion by the appellant to strike stated parties of page 39 of the respondent's brief on an appeal from an order of the Family Court, Richmond County, dated April 16, 2009, on the ground that the material contained in those portions of the brief is not properly before this court.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof; and it is further,
ORDERED that the appellant's time to serve and file a reply brief is enlarged until September 7, 2010, and the reply brief, if any, must be served and filed on or before that date.
