Motion by appellant for a stay pending the determination of an appeal from an order of the Civil Court of the City of New York, Kings County, entered April 29, 2010.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is,

ORDERED that the motion by appellant for a stay is denied without prejudice to renewal upon proper papers.

Appellant has failed to submit an affidavit of service showing that respondent was served with this motion. Moreover, upon renewal, appellant shall set forth good cause for his failure to comply with the deposit requirement contained in the order to show cause.
