Motion by appellant for a stay of the trial scheduled for December 14, 2010 pending the determination of an appeal from an order of the City Court of the City of New York, Kings County, entered March 23, 2010.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is,
ORDERED that the motion by appellant for a stay pending the determination of the appeal is granted on condition the appeal be perfected by November 5, 2010; and it is further,
ORDERED that in the event the appeal is not perfected on or before November 5, 2010, the court, on its own motion, may dismiss the appeal, or respondent may move to dismiss the appeal on three days' notice, and may serve such application in person.
