| DECISION & ORDER ON MOTION |
Motion by the defendant Nicole Halkiopoulos for leave to appeal to this court from an order of the Supreme Court, Queens County, dated August 12, 2010, and, inter alia, to direct the Queens County Clerk to cancel a certain notice of pendency and to stay the plaintiff from filing further notices of pendency against the subject premises.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,
ORDERED that the motion is otherwise denied as academic.
