| DECISION & ORDER ON MOTION |
Motion by the appellant for leave to file a second supplemental brief on an appeal from a judgment of the Supreme Court, Kings County, rendered January 7, 2008, raising an issue that the trial court should have suppressed certain lineup identification evidence.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted, and on or before September 15, 2010, the appellant shall serve and file a second supplemental brief in the form appended to the motion papers; and it is further,
ORDERED that the respondent's brief, if any, in response to the appellant's second supplemental brief shall be served and filed on or before October 15, 2010; and it is further,
ORDERED that the appellant's supplemental reply brief, if any, shall be served and filed on or before October 25, 2010.
