DECISION & ORDER ON MOTION

Motion by E. Paul Stewart for leave to appeal to this court from an order of the Family Court, Kings County, dated July 27, 2010, to stay enforcement of the order pending hearing and determination of the appeal, and to unseal the in camera testimony of the subject child.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is granted; and it is further,

ORDERED that the branches of the motion which are to stay enforcement of the order dated July 27, 2010, and to unseal the in camera testimony of the subject child are denied.
