On the court's own motion, it is
ORDERED that its decision and order on motion dated August 26, 2010, in the above-entitled matter, which granted a motion by the appellant, on an appeal from a judgment of the Supreme Court, Queens County, rendered December 17, 2008, is amended by deleting from the decretal paragraph the words "assigned counsel" and substituting therefor the words "retained counsel."
