It is Ordered that the motion for a summary reversal of the trial court's order is denied, without prejudice to raising this issue in the appellant's brief on a perfected appeal. The cross motion is granted only to the extent of dismissing the appeal unless it is perfected by no later than the December 2010 term - the filing deadline is October 12, 2010. In the event of appellant's failure to comply with the foregoing condition, the respondent may move on five days' notice for an order dismissing the appeal.
