Application by the appellant pro se, in effect, to vacate a decision and order on motion of this court, dated July 16, 2010, which granted his motion for leave to serve and file a supplemental brief on an appeal from an order of the Supreme Court, Kings County, dated July 27, 2009, and to deem the motion withdrawn.
Upon the application and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted, the decision and order on motion dated July 16, 2010, is recalled and vacated, and the motion for leave to serve and file a supplemental brief is deemed withdrawn.
