DECISION & ORDER ON MOTION

Motion by Arrow Line Striping Co., the appellant on an appeal from an order of the Supreme Court, Richmond County, dated September 12, 2008 (Appellate Division Docket No. 2008-09949), to strike the brief filed by the plaintiff-respondent in connection with an appeal from an order of the same court, dated July 8, 2009 (Appellate Division Docket No. 2009-07091), on the ground that it improperly raises arguments for the first time on appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
