On the court's own motion, it is
ORDERED that its decision and order on motion dated September 9, 2010, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:
Appeals by Tori S. Lannaman from two orders of the Family Court, Dutchess County, dated February 23, 2010, and March 2, 2010, respectively. The appellant's brief was filed in the office of the Clerk of this court on August 13, 2010. Pursuant to Family Court Act §§ 1118 and 1120, and upon the certification of Melissa C. Rutkoske, Esq., dated August 9, 2010, it is
ORDERED that the respondent Tina Minus is granted leave to proceed as a poor person on the appeals, and the following named attorney is assigned as counsel to respond to the appeals:

and it is further,

(2) the respondent is not interested in responding to the appeals, or that she has been unable to contact the respondent, and wishes to be relieved of the assignment.
