It is Ordered that, upon the parties' consent, the landlord's motion for a stay is granted, and tenant's motion to restore, pending before the Housing Court, is marked off-calendar on condition that: 1- Landlord perfect its appeal by no later than the January 2011 Term - the filing deadline is November 9, 2010. In the event of landlord's failure to comply with the foregoing condition, tenant may move on five days' notice for an order vacating the stay.
