On the court's own motion, it is
ORDERED that its decision and order on motion dated August 26, 2010, in the above-entitled matter, which granted the appellant's motion for leave to file a late notice of appeal from a judgment of the Supreme Court, Kings County, rendered September 2, 2009 (Appellate Division Docket No. 2010-08170), for leave to prosecute the appeal as a poor person, and for the assignment of the same counsel as was assigned to prosecute an appeal from a judgment of the same court also rendered September 2, 2009 (Appellate Division Docket No. 2009-09955), is amended by adding to the caption thereof "Indictment No. 12506/08."
