The People, etc., respondent, v Criston Lopez, appellant. (Ind. No. 10755/06)
| DECISION & ORDER ON MOTION |
Motion by the appellant, pursuant to CPL 460.20, for a certificate granting leave to appeal to the Court of Appeals from a decision and order of this court, dated March 2, 2010 (see People v Lopez, 71 AD3d 694), which affirmed a judgment of the Supreme Court, Queens County, rendered November 20, 2007.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is dismissed, as the appellant's prior application for leave to appeal to the Court of Appeals was denied (see People v Lopez, 14 NY3d 889), and only one application for leave to appeal to the Court of Appeals may be made (see CPL 460.20; People v Spence, 82 NY2d 671).
