| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from an order of the Supreme Court, Queens County, entered June 12, 2009, to extend the time to comply with a decision and order on motion of this Court dated June 18, 2010, which denied the branch of the respondent's motion which was to dismiss the appeal on condition that the appellant serve and file a supplemental record by a date certain.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that motion is granted, and the appellant's time to comply with the decision and order on motion dated June 18, 2010, is granted, and the appellant's time to serve and file a supplemental record containing the documents listed in the decision and order on motion of this Court dated June 18, 2010, is enlarged until September 23, 2010; and it is further,
ORDERED that no further extensions of time shall be granted; and it is further,
ORDERED that the respondent's time to serve and file a brief is enlarged until October 25, 2010, and the respondent's brief must be served and filed on or before that date.
