DECISION & ORDER ON MOTION

Separate motions by the appellant, in effect, to withdraw a brief filed in connection with appeals from two orders of the Family Court, Nassau County, dated June 19, 2009, and October 5, 2009, respectively, and for leave to file a replacement brief.

Upon the papers filed in support of the motions and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motions are granted, the appellant's brief is deemed withdrawn, and on or before October 18, 2010, the appellant shall serve and file a replacement brief; and it is further,

ORDERED that on the court's own motion, the briefs filed by the respondent and the attorney for the children are stricken and the respondent and the attorney for the children shall serve and file replacement briefs, if any, in accordance with any scheduling orders issued by the Clerk of this Court (see 22 NYCRR 670.8[b]).
