Motion by the respondent-appellant for leave to renew an appeal and cross appeal from an amended judgment of the Supreme Court, Nassau County, entered June 18, 2009, which was determined by decision and order of this court dated June 29, 2010, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this court. Cross motion by the appellant-respondent for leave to reargue stated portions of its appeal.
Upon the papers filed in support of the motion and cross motion and the papers filed in opposition thereto, it is
ORDERED that the motion and cross motion are denied.
