Motion by the appellant on an appeal from an order of the Supreme Court, Nassau County, entered September 26, 2008, which was determined by decision and order of this court dated March 30, 2010, to be awarded costs and disbursements in connection with a supplemental record, filed in compliance with a decision and order on motion of this court dated May 8, 2009.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied as unnecessary as the appellant was awarded costs in the decision and order of this court dated March 30, 2010 (see CPLR 8301).
