DECISION & ORDER ON MOTION

2010-1231 Q C
In the Matter of the Application of George Livingston Ferguson for Leave to Change his Name to General President.

Application by petitioner George Livingston Ferguson, pursuant to CPLR 5704 (b), for an order granting a petition for leave to change his name to "General President," which petition was denied by an order of the Civil Court of the City of New York, Queens County (Charles S. Lopresto, J.), dated and entered on May 23, 2010.

Upon the papers filed in support of the application, it is,

ORDERED that the application by petitioner is denied.

The Civil Court did not improvidently exercise its discretion in denying petitioner's application to change his name from George Livingston Ferguson to "General President." As the Civil Court noted, the proposed name gives the appearance of a title of authority, which might tend to confuse those members of the public who come into contact with petitioner (see Matter of Thompson, 82 Misc 2d 460, 461 [1975]; see generally Matter of Bishop, 11 Misc 3d 1058[A], 2006 NY Slip Op 50274[U]; Matter of Miller, 162 Misc 2d 527 [1994]; Matter of Sakaris, 160 Misc 2d 657 [1993]; Matter of Douglas, 60 Misc 2d 1057 [1969]).

PESCE, P.J., GOLIA and RIOS, JJ., concur.
