DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Alexander Sun, Appellant.

Motion by appellant for leave to prosecute an appeal from a judgment of conviction of the Criminal Court of the City of New York, Queens County, rendered June 3, 2010, as a poor person and for the assignment of counsel.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is,

ORDERED that the motion by appellant for leave to prosecute the appeal as a poor person and for the assignment of counsel is denied without prejudice to renewal upon furnishing this court with proper papers.

Appellant has failed to furnish this court with the amount he has on deposit in his bank account and the amount of his savings.
