Motion by appellant for leave to appeal to this court from an order of the Civil Court of the City of New York, Kings County, entered December 4, 2008. Separate motion by appellant for a stay pending the determination of the appeal.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED, on the court's own motion, that the motions are consolidated for purposes of disposition; and it is further,

ORDERED that the motion for leave to appeal is denied as unnecessary; and it is further,

ORDERED that the motion for a stay pending the determination of the appeal is denied.

The appeal is taken as of right from the order of the Civil Court entered December 4, 2008.
