DECISION & ORDER ON MOTION

Motion by the respondent pro se on an appeal from an order of the Family Court, Orange County, dated January 4, 2010, for poor person relief, and for the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the branch of the motion which is to waive the filing fees is denied as unnecessary as no fees are payable by the respondent; and it is further,

ORDERED that the motion is otherwise denied; and it is further,

ORDERED that the respondent's time to serve and file a brief on the appeal is enlarged until October 22, 2010.
